“Partner” means the professional provider of accommodation (villas, condos, apartments), transportation (e.g. car rentals, cruises, taxis, airport rides), event management, chauffer services, private chefs, and other services such as restaurants, massage therapists, outdoor activities and adventure and water sports, photographers, videographers, grocery service, bartenders, mixologists, party busses, balloon decorators, cake makers.

“Concierge services” refers to the services provided by Aruba Hostess VP & C, serving as an intermediary between you (the Client) and our Partners.

“Partner Service” represents a service provided by our Partners.

“Client” or “you” refers to the individual using the services of Aruba Hostess VP & C, including those browsing our web site or contacting us via e-mail, social media or telephone.

If you are inquiring about or booking Accommodations or services for more than yourself, all references to “You” (including derivatives like “Your”) shall be understood to mean you on behalf of yourself and every individual in your group for whom you are requesting a quote or booking Accommodations or any service through Aruba Hostess VP & C.

Aruba Hostess VP & C does not provide any of the services, accommodations or any additional services requested by the Client or listed on our website, social media or other platforms. We simply act as intermediaries between the Client and our Partners.

Aruba Hostess VP & C is not involved in any agreements for accommodations and services. We do not act as a landlord, property manager or real estate broker. Property owners, property managers, and homeowners of accommodations, as well as third-party service providers (“Partners”), are solely responsible for understanding and complying with all applicable laws, rules, regulations, and agreements with the client.

You explicitly authorize Aruba Hostess VP & C to coordinate travel arrangements and arrange accommodations and services on your behalf with Service Partners.  Property Managers, homeowners, and Partners, and not Aruba Hostess VP & C, will be liable to you for the relevant provision of accommodations and services, respectively. You acknowledge that Aruba Hostess VP & C is not a joint vendor of these accommodations and services, and you are responsible for any travel fees or costs that Aruba Hostess VP & C arranges on your behalf.

Scope of our services

Through our website, we offer Clients a wide range of third party services, including accommodation, transportation, car rentals, yacht charters, private chef services, private bartenders/mixologists, balloon decorations, custom cake deliveries, massages, restaurant reservations, and event management. These services are provided through our network of Partners in Aruba and we can book those on behalf of the Client.

Upon request from a Client, our concierge services may expand to include the reservation or booking of additional services that are not explicitly listed on our website. In such case, Aruba Hostess VP & C will confirm to Client that the Vendor/ Partner is able to provide the requested service and will also provide the information and the estimate for the rendering of this specific service.

We collect Clients’ information and preferences regarding services for ordering, purchasing, reserving, and hiring. From the moment you contact us and share the details of the services you’re interested in, we act solely as an intermediary between you and our Partners. We pass on your preferences to the appropriate Partners and relay relevant information from the Partners back to you for your consideration.

By accepting the cost estimate, the Client consents to the transfer of their personal data to the Partners for contract handling. The processing of the Client’s personal data during this process is governed by our Privacy Policy.

After finding the most suitable Partners for each requested service, we gather necessary documents from them, including pricing and specific terms and conditions, for your review. Once you approve these conditions, we proceed to finalize the reservation process with our Partners on your behalf.

When providing our concierge services, the information we share with the Client regarding the Partner’s service is based on the details provided to us by the respective Partner.

While we strive to perform our services with reasonable skill and care, we cannot guarantee the accuracy, completeness, or correctness of all information regarding our Partners’ services. We are not liable for any errors, including obvious and typographical errors, inaccuracies, misleading or untrue information, or for any failure to deliver information.

Our Partner Services

Each Partner is responsible for ensuring that the information they provide about their services is accurate, complete, and correct.

Our Partners’ services are governed by their specific terms and conditions, which they establish. When you make a reservation with a Partner through us, you must agree to and accept their specific terms and conditions, which may include detailed information about fees, taxes, cancellation policies, and no-show policies specific to that Partner. Some rates, fees, or special offers established by our Partners may not be eligible for cancellation, refund, or changes.

We encourage you to carefully read these conditions before booking.

Once you contact our concierge team, you will receive messages from us to gather additional information from you and provide relevant details regarding services that can be tailored to meet your preferences and requirements.

Once the service is booked through us, you can continue communicating through Aruba Hostess VP & C.

To secure a booking of services through Aruba Hostess VP & C, and to ease communication with our Partners, it is essential that you provide your correct email address, phone number, and other contact details. We cannot be held responsible or liable for any incorrect or misspelled email addresses, inaccurate (mobile) phone numbers, or other contact details that are provided to us. If you update your contact information after initially contacting Aruba Hostess VP & C, it is your responsibility to inform us of these changes.

Payment of the Partners’ services

The Partners will invoice the Client directly or indirectly, via Aruba Hostess, for their services based on their own terms and conditions. Certain rates or special offers may require specific payment conditions, so we advise you to carefully review the payment terms.

Disclaimer

To the extent permitted by law, Aruba Hostess VP & C will only be liable for direct damages that you actually suffer, pay, or incur as a result of a failure on our part related to the Concierge Service.

To the extent permitted by law, neither Aruba Hostess VP & C nor any of our employees, directors or representatives shall be liable for:
i) Any of the services provided by our Partners;
ii) Any inaccuracies in the information (including rates and availability) provided by our Partners;
iii) Any injury, death, damage, accident, irregularity, property damage, additional expenses, or other (indirect, direct) damages, losses, or costs incurred by you, whether caused by acts, errors, delays, breaches, negligence (gross or otherwise), willful misconduct, non-performance, omissions, misrepresentations, tort, or strict liability by or attributable (wholly or partly) to the Partners (including their directors, employees, agents, officers, representatives, subcontractors, or affiliated companies), including any cancellation or partially cancelation, delay, overbooking, strike, force majeure, or other events beyond our control.

 Aruba Hostess VP & C is not responsible for, and disclaims any liability regarding, the use, validity, quality, suitability, fitness, and proper disclosure of the service. We make no representations, warranties, or conditions of any kind in this regard.

You acknowledge and agree that the service Partner assumes full responsibility and liability for the service, including any warranties and representations made by the Partner. Any complaints or claims related to the service (including issues with special/promotional prices, policies, or specific requests) should be addressed directly with the Partner. Aruba Hostess VP & C is not responsible for and disclaims any liability regarding such complaints, claims, and liabilities.

Intellectual property rights

Users of this website acknowledge and agree that all intellectual property rights, including trademarks, trade names, and copyrights, pertaining to the content, information, and materials on our website belong to Aruba Hostess VP & C, unless otherwise indicated. Aruba Hostess VP & C is the exclusive owner of all rights, titles, and interests in the intellectual property rights associated with the website through which its services are provided.

Any dispute arising from these general terms and conditions and our services shall be exclusively submitted to the competent courts in Aruba. However, notwithstanding this jurisdiction clause, a consumer may also initiate proceedings in their country of domicile for enforcement of mandatory laws applicable to them.
